This User Agreement and Terms of Use (the “Agreement”) is a legally binding contract between Clavrit Digital Solutions Private Limited (the “Company”) and you, accessing or using the “MotoCatch” mobile application and motocatch.com (the “Platform”).
By creating an account, recording, uploading, or interacting with the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must immediately cease use and uninstall the application.
The Platform uses independent AI models to process video and image data recorded by users, detect potential traffic violations, extract plate text via OCR, generate localized incident data, and format evidence records.
The Platform is an independent crowd-sourced reporting tool. The Company explicitly declares that it does not possess an official MOU, license, endorsement, or formal partnership with any government body, ministry, or law-enforcement agency at this time. It functions solely as a technological pipeline to aggregate potential evidence and forward it to verified channels.
The Platform is strictly an alerting and evidence-generation tool. It does not make automated enforcement decisions, nor does it possess the authority, capability or legal mandate to issue official citations, fines, challans, or penalties. All enforcement, verification and ticketing remain exclusively within the statutory domain of competent government and police authorities.
Services are intended strictly for individuals at least 18 years of age with the legal capacity to contract under the Indian Contract Act, 1872. The Platform is not intended for minors, and we do not knowingly collect data relating to children. If a minor is discovered to have created an account, we reserve the right to terminate it and purge associated metadata without notice.
By using the recording functions, you represent, warrant and covenant that:
As between you and the Company, the Company owns all right, title and interest in the Platform, its source code, interface designs, detection models, algorithms and logos.
By uploading footage, images, location data and notes, you grant the Company an irrevocable, perpetual, worldwide, royalty-free, sub-licensable license to store, crop, blur, analyze, aggregate and transmit such media and derived metadata for operational execution, automated reporting and transmission to verified channels.
The Platform is provided on an “as-is” and “as-available” basis without warranties of any kind. The Company makes no representations regarding the accuracy, validity, reliability or completeness of the AI detection models, plate-text extraction, or geocoding. We do not guarantee that any report will result in official review, investigation or prosecution.
To the maximum extent permitted by law, the Company, its directors, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of data, reputation, or legal actions arising from your use of the Platform, AI errors, or transmission of evidence.
You agree to indemnify and hold harmless the Company from any claims, liabilities, damages, losses, costs or expenses (including legal fees) arising from your breach of this Agreement, unauthorized use, or any defamatory, false or malicious reports submitted through your account.
This Agreement is governed by the laws of the Republic of India. Any dispute shall first be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue shall be New Delhi, India, and the language English. Subject to arbitration, the courts of New Delhi shall have exclusive jurisdiction.
These Terms and Conditions for Verified Channel Distribution (the “Distribution Terms”) establish how reporting outputs, metadata and structured packages compiled by the MotoCatch platform are routed and published to target destinations.
The Platform explicitly limits distribution of automated reports, derived plate data, localized coordinates and blurred media to verified channels established for authorized administrative oversight or traffic-management review. The Platform restricts automated pipelines from publishing evidence streams directly to unrestricted public forums or publicly indexed channels.
To safeguard the privacy of reporting parties and enforce confidentiality, the routing system executes the following rules:
The Company reserves the right to amend or replace these instruments at any time to adapt to technical refactoring, infrastructure transitions, or evolving legal interpretations issued by the Data Protection Board of India. Notification of substantial updates is communicated by refreshing the modification dates on motocatch.com. Continued use following updates constitutes acceptance of the modified frameworks.
